What are the Requirements of British citizenship ?

  • You would have been a British citizen, or could have been, in the Home Secretary’s opinion, except for —
  • historical legislative unfairness
  • an act or omission of a public authority
  • exceptional circumstances relating to you
  • The Secretary of State may also take your character into account.

If you are successful in making an application through this process, the person will acquire British citizenship independently of descent and may pass it to any children born outside of British territory.

The three reasons that are listed in the Statute to be eligible for application under this route are:

  1. Historical legislative unfairness – There is no set number of circumstances that could be relevant in this case, but historical legislative unfairness would cover situations where the law did not treat men and women equally or did not treat children of unmarried parents equally with children of married parents.
  •  An act or omission of a public authority – Errors made by government agencies or local governments count as acts or omissions of a public authority, but applicants must identify the act or omission and explain how they would have otherwise been able to apply for citizenship in the UK.
  • Exceptional circumstances relating to [the individual]- Cases involving exceptional circumstances will be evaluated on their own merits.
  • The Home Secretary may also consider a person’s “good character” while deciding whether to approve their British citizenship application.
  • These provisions are not intended to be used in lieu of meeting the requirements for naturalization or registration through another route. You may be registered if you can demonstrate that you did not become, or were unable to become, a British citizen as a direct result of historical legislative injustice, an act or omission of a public body, or exceptional circumstances affecting you. If you do not meet one of these requirements, you may want to consider whether there is another way for you to become a British citizen.
